Terms of Service

Please read these Terms of Service carefully before using Poke. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Poke ("Company", "we", "us"). These Terms govern your access to and use of our network acceleration software, applications, websites, and all associated services (collectively, the "Service").

By creating an account, downloading our software, or otherwise accessing the Service, you represent that you are at least 16 years of age and have the legal capacity to enter into this agreement.

2. Service Description

Poke provides proprietary network acceleration technology designed to optimize connection speed, reduce latency, and improve network stability for users connecting to remote servers and services. The Service includes:

Client applications for Windows, macOS, iOS, and Android
Access to our global network of acceleration nodes
Customer support and technical assistance
Account management via our web portal

3. Account Registration & Security

To use the Service, you must create an account by providing a valid email address and a password. You agree to:

Provide accurate and complete registration information
Maintain the confidentiality of your account credentials
Notify us immediately of any unauthorized access to your account at [email protected]
Accept responsibility for all activities that occur under your account

You may not share, sell, or transfer your account to any third party. Each subscription is valid for one user only unless you have purchased a plan that explicitly permits multiple users.

4. Subscription Plans & Payment

Poke offers various subscription tiers. All prices are displayed in USD unless otherwise stated and are exclusive of applicable taxes.

Billing Cycles: Subscriptions are billed on a monthly or annual basis, automatically renewing at the end of each period unless cancelled.
Cancellation: You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period.
Refund Policy: We offer a 7-day money-back guarantee for first-time subscribers. Refund requests must be submitted within 7 days of your initial purchase by contacting [email protected].
Price Changes: We reserve the right to change subscription prices. You will be notified at least 30 days in advance. Continued use after the price change takes effect constitutes acceptance of the new price.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must NOT:

Use the Service for any illegal activity under applicable law, including but not limited to copyright infringement, fraud, or unauthorized access to computer systems
Distribute, transmit, or store child sexual abuse material or any other content that exploits minors
Conduct distributed denial-of-service (DDoS) attacks, port scanning, network intrusion, or any form of cyber attack
Send unsolicited bulk email (spam) or engage in any form of mass marketing without consent
Resell, sublicense, or commercially redistribute the Service without our written permission
Attempt to reverse-engineer, decompile, or extract the source code of our software
Use the Service to circumvent export control laws or sanctions lists
Engage in cryptocurrency mining or any activity that places disproportionate load on our infrastructure

Violation of this Acceptable Use Policy may result in immediate account suspension or termination without refund.

6. Intellectual Property

All intellectual property rights in the Service, including but not limited to software, logos, trademarks, trade secrets, and proprietary acceleration protocols, are owned by Poke or its licensors. These Terms do not grant you any ownership rights in the Service.

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use our client applications solely for your personal, non-commercial use in accordance with these Terms.

7. Privacy

Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in our Privacy Policy.

8. Service Availability & Modifications

We strive to maintain 99.9% uptime across our node network. However, we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:

Scheduled maintenance (announced at least 48 hours in advance)
Emergency maintenance required to protect system integrity
Force majeure events including natural disasters, governmental actions, or third-party infrastructure failures

We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with reasonable notice. We will notify users of material changes via email or in-app notifications.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will meet your specific requirements, that results obtained through the Service will be accurate or reliable, or that errors will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Poke SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total cumulative liability for any claims arising under these Terms shall not exceed the total fees paid by you in the 12-month period preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Poke and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms or your use of the Service in a manner not authorized by these Terms.

12. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your account immediately and without notice if we determine, in our sole discretion, that you have violated these Terms. Upon termination, your right to use the Service ceases immediately. Account data will be deleted in accordance with our Privacy Policy.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of Singapore, without regard to conflict of law principles. Any dispute arising from or relating to these Terms shall first be submitted to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration under the rules of the Singapore International Arbitration Centre (SIAC), conducted in English in Singapore.

Notwithstanding the above, either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.

14. Changes to Terms

We may revise these Terms at any time. We will provide at least 14 days' notice of material changes via email to your registered address and by posting a notice on our website. If you continue to use the Service after the revised Terms take effect, you agree to be bound by the new Terms.
